지방 정부는 세 명의 네이멍구[内蒙古]  그리스도인들이 자신들에게 내려진 "이단" 범죄에 대한 가혹한 판결에 항소 할 기회를 거부함.

(네이멍구[内蒙古], 후허하오터[呼和浩特]– 2013년 10월 8일)  네이멍구에 거주하는 세 명의 그리스도인들이 이번 여름에 "이단" 범죄로 유죄 판결을 받아 장기간의 징역형을 선고받고 지방 정부에 항소와 재심을 요구했으나 반복적으로 저지당했다. 

 그 세 명은 후이 공(Hu Gong), 웬 웨이홍(Wen Weihong) 그리고 리우 아잉(Liu Aiying)라는 여성인데, 이들은 7월 25일 네이멍구 자치주의 수도인 후허하오터의 위취안구(玉泉区) 인민 법정에서 "지방법 시행령에 저촉된 이단 단체 결성과 남용" 이라는 죄목으로 유죄 판결을 받았다. 

중국 형법 제 300조에 따르면, 이 범죄는 " 3년 이상 7년 이하의 유기 징역"에 해당된다. 그러나 후이(Hu)는 9년 징역 형을 선고받았고, 웬(Wen)과 Liu(리우)는 8년 형을 선고받았다.  

세 명의 그리스도인들은 일반적으로 "외치는 자들”로 불리는 단체의 일원인데, 이 단체는 1920년 대와 1930년 대에 워치만 니에 의해 설립된 중국 토착교회의 논란이 된 한 지류이다. 워치만 니의 제자인 위트니스 리는 공산화되기 직전인 1949년에 중국 본토를 떠나 대만에 지방 교회를 세웠고, 이후에 지방 교회를 미국에까지 확산시켰다. 

 후이(Hu), 웬(Wen) 그리고 리우(Liu)는 2012년 7월 4일 ‘외치는 자들’과 지방 교회(Local Church)에서 출판된 전도 책자 수백 부를 배포한 혐의로 경찰서 유치장에 갇혔다. 그들은 2012년 7월 5일과 6일에 범죄 혐의로 구금되었고, 2012년 8월 11일에 공식 체포되었고, 2013년 4월 10일에 기소되었다.  

‘차이나 에이드’(ChianAid)는 중국본토 전역에서 벌어진 ‘외치는 자들’에 대한 박해에 깊이 우려 하고, 중국 정부가 "이단"라는 말을 빌려 이러한 믿는 이들을 박해하는 것에 대해 격분한다. 일곱 명(10월 12일 수정)의 ‘외치는 자들’ 그리스도인들이 허난(河南) 성  핑딩산(平顶山) 시에서 "이단" 범죄로 선고받은 것과 함께 이번 사건도 심각한 종교 탄압의 사례들이다. 지방 교회(the Local Church)가 과거에는 논란이 있었지만, 전 세계의 기독교인들 대부분은 이 단체를 더 이상 이단적이라고 생각하지 않는다. 중국 정부는 자신들의 종교적인 신자들을 박해하기 위한 하나의 수단으로 "이단" 이라는 낙인을 사용하고 있는 것이 분명하다. 

 네이멍구에서7월 25일에 있었던 재판에서 후허하오터 "중급 인민법원(中级人民法院 )"은 그 세 명이 "이단" 믿는 이들이며, 그들의 집에서 발견된 문서와 씨디(CD)들은 "이단 확산 자료들"이고,  "그 정황들이 특별히 심각하므로" 중형을 선고한다고 판결했다. 변호사들에 의하면, "특별히심각한 정황들"은 단지 그 세 명의 피고인들이 ‘크리스천 리서치 인스티튜트’(CRI)가 발간한 소책자를 포함한 지방교회 (Local Church) 출판물 수백 부를 가지고 있었다는 것인데, 이 소 책자는 이단과 이교를 연구하는 미국의 기독교 변증 단체인 ‘크리스천 리서치 인스티튜트’(CRI) 가 지방 교회를 "이단"이라고 낙인찍었던 초기의 결정을 뒤짚은 내용을 담은 "우리가 틀렸었다 (We Were Wrong)" 라는 제목의 책이다. 

그 세 명의 믿는 이들이 후허하오터 "중급 인민법원(中级人民法院)에게 자신들이 항소하겠다고 통지하자, 이 사건을 담당한 지방 정부 부서들은 그들이 항소 서류를 접수하지 못하도록 협박과 겁을 주는 작전을 구사했고 항소를 담당하는 변호사들을 고용하지 못하도록 방해했다.  

그러나 후이(Hu)의 가족들은 상해 소재 Huiye 법률사무소의 장 페이홍(Zhang Peihong) 씨를 변호사로 고용했고, 그는 즉시 후허하오터 중급 인민법원에 찾아가 그 사건 자료들을 요청했다. 그러나 담당 판사는 이 사건은 이미 상급 법원에서 항소가 기각되었고, 판결문들이 이미 인쇄 되었으며, 이 사건의 재심은 이뤄질 수 없다 라고 변호사에게 말했다. 이것이 이 사건의 현재 상황이며, 장(Zhang) 변호사가 현재 할 수 있는 유일한 일은 후이(Hu)의 가족들을 대리하여 탄원서를 접수하는 것과 상급 기관에 항소하는 것이다.  

차이나 에이드(ChianAid)는 세 명의 그리스도인 가족들 모두가 재정적으로 어려움을 겪고 있다고 들어왔다. 후이(Hu)의 아내는 사람들의 머리를 깎아 주고 벌은 수입으로 근근히 살고 있는데, 이 부부는 24살 난 딸이 한 명 있다. 웬(Wen)의 아내는 무직이고, 고등학생 또래의 딸이 하나 있다. 리우(Liu)의 남편은 장애자이고, 이들 역시 고등학생 나이의 딸이 하나 있다. 

 차이나 에이드(ChianAid)는 이 사건의 진행과정을 면밀히 감시할 것이며, 전 세계 그리스도인 들에게 이 고통받고 있는 세 가족들을 돕고, 이 세 명의 믿는 이들을 위해 기도해 줄 것을 요청할 것이다. 차이나 에이드(ChinaAid)는 중국 정부가 모든 종교적 믿는 이들에 대한 탄압을 즉시 종결하고, 종교의 자유에 관한 시민들의 헌법적 권리를 보장하고, 믿는 이들이 "이단" 범죄로 부당하게 판결된 사건들을 신속히 바로 잡도록 강력히 촉구한다.


Local government denies three Inner Mongolia Christians chance to appeal their heavy sentences for "cult" crimes

(Hohhot, Inner Mongolia—Oct. 8, 2013)  Three Christians in Inner Mongolia who were convicted of cult crimes this summer and sentenced to long prison terms have been repeatedly blocked by the local government from appealing and seeking a re-trial. 

 The three—Hu Gong and Wen Weihong, and a woman named Liu Aiying—were convicted on July 25 of "forming and using a cult organization to undermine the implementation of the laws of the State" by the Yuquan District People's Court in Hohhot, capital of the region of Inner Mongolia. 

 According to Article 300 of China's Criminal Code, this crime is punishable by a "fixed-term imprisonment of not less than three years but not more than seven years." However, Hu was sentenced to a nine-year prison term and Wen and Liu were both sentenced to eight years. 

 The three Christians are part of a group commonly called "the Shouters," a controversial offshoot of the indigenous Chinese church founded by Watchman Nee in the 1920s and 1930s. A disciple of Nee, Witness Lee, left mainland China shortly before the Communist takeover in 1949 and established the LocalChurch in Taiwan and later expanded it to the United States. 

 Hu, Wen and Liu were taken into police custody on July 4, 2012 for distributing several hundred copies of evangelical literature published by the Shouters and the LocalChurch. They were criminally detained on July 5 and 6, 2012, formally arrested on Aug. 11, 2012, and indicted on April 10, 2013.

 ChinaAid is deeply concerned about the persecution of the Shouters throughout mainland China and outraged over the Chinese government’s use of the word “cult” to persecute these believers. This case along with the seven (corrected on Oct. 12) "Shouters" Christians also sentenced for "cult" crimes in Pingdingshan, Henan province, are instances of serious religious persecution. While the Local Church has aroused controversy in the past, most Christians worldwide no longer regard the denomination as heretical, and the Chinese government is clearly using the “cult” label as a tool for its persecution of religious believers.  

At the July 25 trial in Inner Mongolia, the Hohhot Intermediate People's Court ruled that the three were "cult" believers, that the literature and CDs in their homes were "cult propaganda materials," and that "the circumstances were particularly serious," hence the heavy sentences. According to the defense lawyers, the "particularly serious circumstances" was simply because the three defendants were in possession of several hundred copies of Local Church literature, including a booklet published by the Christian Research Institute, an American Christian apologetics ministry that specializes in cults and heresy, about the Local Church called "We Were Wrong" that reversed the Institute's earlier labeling of the Local Church as a "cult." 

 When the three believers informed the Hohhot Intermediate People’s Court that they were going to appeal, local government departments handling the case used threats and scare tactics to prevent them from filing their appeal and blocked them from hiring lawyers to handle the appeal. 

 Hu's family, however, did hire a lawyer, Zhang Peihong of the Shanghai Huiye Law Firm, who immediately contacted the Hohhot Intermediate People's Court to request the case files. The judge told him that the case had already been dismissed by the higher court, the sentencing papers were being printed and the case would not be re-tried. This being the case, the only thing Zhang can do is to file a complaint on behalf of Hu's family members and appeal to higher authorities. 

 ChinaAid has learned that the family of all three Christians are struggling financially. Hu’s wife has a meager income from cutting people's hair, and the couple has a 24-year-old daughter. Wen’s wife is unemployed and they have a high school-aged daughter. Liu’s husband is disabled and they also have a high school-aged daughter. 

 ChinaAid will closely monitor the developments in the case and calls on Christians everywhere to help these three suffering families and pray for the three believers. ChinaAid urges the Chinese government to immediately end its persecution of all religious believers, respect its citizens’ constitutional right to religious freedom, and quickly rectify cases in which believers were wrongly convicted of "cult" crimes.

呼吁海内外关注和帮助呼和浩特市三名被重判的基督徒及其亲属

内蒙古呼和浩特市基督徒胡功弟兄、温卫红弟兄和刘爱英姊妹, 仅仅因为信仰了有争议的基督教地方召会“呼喊派”,拥有“呼喊派”书籍并散发了数百份福音资料,就被呼和浩特市玉泉区法院,以刑法第三百条“组织和利用邪教破坏国家法律实施”罪,重判了8-9年的有期徒刑。 

三名被重判的基督徒是在2012年7月4日被抓的,并在当月7月5日和6日被当地公安刑事拘留。同年8月11日,他们三人被批准逮捕。到了2013年4月10日,呼和浩特市玉泉区人民检察院向玉泉区人民法院提起公诉,法院开庭审理后在2013年7月25日判处胡功有期徒刑9年、温卫红和刘爱英各8年有期徒刑。一审开庭时,北京中淇律师事务所刘建邦、王文娟和旭日娜三名律师出庭,为三名被告人提供辩护。但法院根本不顾基本事实,对辩护人的辩护意见完全不采纳,便判决这三名基督徒信仰的是“邪教”,家中的书和光碟是“邪教宣传品”,并认为“情节特别严重”,因而重判三被告。据律师反映,这“特别严重”的情节不过是因为他们持有数百份地方召会的资料,其中包括美国专门研究异端与邪教的基督教研究所(Christian Research Institute, CRI)所出的《我们错了》(《We Were Wrong》)这本为召会平反的小册子。 

一审判决后,三名被重判的基督徒不服判决,向呼和浩特市中级人民法院提出上诉。当地办案机关一直威胁恐吓他们不要上诉,不准他们请律师上诉。但被告人之一胡功的家属还是请了上海汇业律师事务所的张培鸿律师作为上诉案件的辩护人。张培鸿律师接受了委托后,当即和呼和浩特市中院联系查阅案卷和准备开庭,但呼市中院法官回答说:该案已经驳回,判决书已在印刷,法院不会开庭再审了。 现在律师只能帮助家属为之申诉了。

 据本会知悉:这三个被重判的基督徒的家庭都很困难。胡功的太太只能靠帮人理发而得到微博的收入,他有一个24岁的女儿。温卫红的女儿刚上高中,妻子没有工作,现在生活陷于困顿。而刘爱英的女儿才升高一,她的丈夫是个残疾人,没有收入。这三个家庭急需外界的帮助。我们呼吁海内外的基督教机构和弟兄姊妹能关心和帮助这三个困难的家庭,同时,也请关注这三位遭到重判的基督徒在狱中的状况。呼吁教会为他们的命运祷告。  

对华援助协会对中国大陆各地严重迫害 “呼喊派” 基督徒的情况感到严重的忧虑。对中共政府以邪教名义迫害信仰人士的做法深感愤怒。内蒙古这一案例是河南平顶山教案外又一例严重的宗教迫害案件。基督教地方召会在历史上引起很大争议,但在世界范围内,绝大多数基督徒已不把这一教派当作异端。信奉无神论的中共政府有何权柄来界定信仰领域的“正”或“邪”呢?这毫无疑问是假借“邪教”之名行迫害信仰人士之实。我们希望中共政权立即停止对所有信仰者的政治迫害,尊重宪法所规定的公民有宗教信仰自由的权利,迅速纠正一系列被以邪教名义枉判的信徒。
